Multichannel shirt brand Thomas Pink has won a trademark battle against Victoria’ Secret over the latter’s lingerie brand Pink. The high court ruled that Victoria’s Secret had infringed the trademark of the shirt business whose use of an upper case PINK logo on its garment labels and shop fronts commenced in 1984. Judge Colin Birss ruled that similarities between the appearance of the two brands could lead shoppers in Europe to associate Thomas Pink with mass market ladies underwear which would cause a detriment to the reputation of the shirt brand.
