The Information Commissioner has published its guidance on how brands can use legitimate interest under GDPR. The guidance has set out a three-stage test (LIA) which businesses can apply to help them to decide whether particular actions are lawful under legitimate interests. A template has been published on the ICO website which business can make use of.
Whilst this guidance has been issued incredibly close to the commencement date for GDPR, it does now appear that postal marketing has a green light going forward provided that consumers are able to opt out of receiving mailings at any time.
