Fancy dress costume specialist Smiffys has gained a judgement of the Royal Courts of Justice, Intellectual Property Enterprise Court against I Love Fancy Dress Limited for copyright infringement. The Court agreed that I Love Fancy Dress Limited had infringed Smiffy’s copyright by using several of Smiffy’s images on its website, Amazon and eBay stores to advertise for sale its own branded product and the branded product of other fancy dress manufacturers.
The Court ordered that I Love Fancy Dress Limited pay damages and costs to Smiffys in respect of its copyright infringement and further issued an injunction against I Love Fancy Dress Limited to stop it from using such copyright images in the future.
